Vacancies. Any vacancy occurring in any office because of death, resignation, removal, disqualification or otherwise, may be filled by the board of directors for the unexpired portion of the term by the board of directors then in office.

Vacancies. 1. A vacancy shall be defined as an available permanent teaching position in the bargaining unit, or an administrative position established by the District, caused either by promotion, resignation, termination, or a newly created position, provided however in filling regular part-time vacancies the following procedures shall apply: A vacancy in a regular part-time teaching position (less than a full work day) shall be posted at the end of sixty (60) work days and filled within fourteen (14) calendar days of the posted date or the part-time teaching position will be eliminated. 2. Extra duty and extracurricular positions shall be considered vacancies for the next school year and posted by April 15. 3. Vacancies shall be publicized for fourteen (14) calendar days by posting a written notice of such vacant position, with qualifications and job description (where possible), in each school building (administrative office, teachers’ lounge, bulletin boards in District offices, District Web Page). A copy shall be sent by e-mail to all BEA members, and a hard-copy to the BEA President. Such vacancy shall not be filled, except on a temporary basis, until such fourteen (14) day posting has been accomplished. During vacation periods outside the normal school year, the notification requirement shall be filled by giving written notice to each teacher, the Association, and posting a copy in the Superintendent’s Office. If a vacancy has remained unfilled more than 60 days (except by a substitute), the position will not be filled with a permanent teacher until a new posting has been made and its time lines followed. 4. Any teacher may apply for any vacant position, including extra duty positions. In filling the position, however, the District shall consider qualifications, background attainments, and other relevant factors, including service in the District. Teachers may be considered as well as applicants from outside the District. If two (2) or more applicants are equal with regard to all of the foregoing selection standards, the positions shall be filled by (1) from within the District, and (2) by the teacher with the longest continuous service in the District. In all appointments to administrative positions, the District’s decision shall be final. 5. If requested, unsuccessful applicants shall be given reasons for their not attaining the position.

Vacancies. A newly created elected office and a vacancy in any elected office because of death, resignation or removal may be filled by the Board for the unexpired portion of the term at any meeting of the Board.

Vacancies. A vacancy in any office because of death, incapacity, resignation, removal, disqualification or other cause shall be filled in the manner prescribed in this Agreement for regular appointment to such office.

Vacancies. Whenever a vacancy in the Board of Trustees shall occur regardless of the reason for such vacancy, the remaining Trustees may fill such vacancy by appointing an individual having the qualifications described in this Article IV, consistent with applicable limitations under the 1940 Act, by a written instrument signed by a majority of the Trustees then in office or may leave such vacancy unfilled or may reduce the number of Trustees; provided the aggregate number of Trustees after such reduction shall not be less than the minimum number required by Section 4.1. Any vacancy created by an increase in Trustees may be filled by the appointment of an individual having the qualifications described in this Article IV, consistent with applicable limitations under the 1940 Act, made by a written instrument signed by a majority of the Trustees then in office. No vacancy shall operate to annul this Declaration of Trust or to revoke any existing agency created pursuant to the terms of this Declaration of Trust. Whenever a vacancy in the number of Trustees shall occur, until such vacancy is filled as provided herein, the Trustees in office, regardless of their number, shall have all the powers granted to the Trustees and shall discharge all duties imposed upon the Trustees by this Declaration of Trust. Upon the appointment of a successor Trustee and without any further act or conveyance, he or she shall be deemed a Trustee hereunder. The death, declination to serve, resignation, retirement, removal, or incapacity of one or more Trustees, or all of them, shall not operate to annul the Trust or to revoke any existing agency created pursuant to the terms of this Declaration of Trust. Whenever there shall be fewer than the designated number of Trustees, until additional Trustees are elected or appointed as provided herein to bring the total number of Trustees equal to the designated number, or the number of Trustees as fixed is reduced, the Trustees in office, regardless of their number, shall have all the powers granted to the Trustees and shall discharge all the duties imposed upon the Trustees by this Declaration of Trust, and during the period during which any such vacancy shall occur, only the Trustees then in office shall be counted for the purposes of the existence of a quorum or any action to be taken by such Trustees. Vacancies. 21.01 All vacancies, term positions and new positions which fall within the scope of this Agreement shall be posted for a minimum of seven (7) calendar days. Term positions of less than ninety (90) days shall not be required to be posted or filled with the process set forth below, and may be filled by way of temporary assignment or external hire. 21.02 The posting shall state the closing date for applications, the location of the position, the classification, the duties and responsibilities of the position, the qualifications required, equivalent to full-time (EFT), and salary range. PCAM shall be provided with a copy of all postings as they are issued. Practice descriptions shall be available to applicants upon request. 21.03 The selection of Employees for vacant or new positions shall be on the basis of qualifications, ability, and prior work performance. Where two or more applicants are considered relatively equal using the above assessment criteria, seniority shall be the determining factor. 21.04 The name of the successful applicant, posting number and the position awarded will be posted in an electronic format accessible to all Employees for a period of seven (7) calendar days with a copy of this information forwarded to PCAM. Any Employee who was interviewed but was not the successful applicant shall be entitled to consult with the hiring Manager. Such consultation will take place within two (2) weeks of the request. The purpose of the consultation shall be to provide the Employee with constructive feedback regarding their application. An unsuccessful applicant may inquire of the hiring Manager or the Human Resources Consultant as to why they were not selected for an interview. 21.05 A term position shall be for a specific period of time, up to a maximum of twelve (12) months, unless mutually agreed by PCAM and the Employer to extend. The maximum duration as per above shall not apply in the following situations: (i) In case of replacement of an Employee on Maternity or Parental leave the maximum duration shall be eighteen (18) months. The Employer shall state on the job posting that the said term is a “Maternity/Parental leave of absence term” which may expire sooner than indicated, subject to minimum notice of two (2) weeks or one pay period, whichever is longer.
