Labor Rates definition

Labor Rates means a sum equal to the regular hourly wage rate required to be paid to Others (hereinafter defined) employed in Class A Office Buildings pursuant to an agreement between R.A.B. and Local 32B-32J; provided, however, that: (i) if, as of October 1st of any Comparison Year, any such agreement shall require Others in Class A Office Buildings to be regularly employed on days or during hours when overtime or other premium pay rates are in effect pursuant to such agreement, then the term “regular hourly wage rate”, as used in this Section 6.3 shall mean the average hourly wage rate for the hours in a calendar week during which Others are required to be regularly employed; (ii) if no such agreement is in effect as of October 1st of any Comparison Year with respect to Others, then the term “regular hourly wage rate”, as used in this Section 6.3 shall mean the regular hourly wage rate actually paid to Others employed in the Building by Landlord or by an independent contractor engaged by Landlord; and (iii) the term “regular hourly wage rate” shall exclude all benefits of any kind, including those payable directly to taxing authorities or others on account of the employment and all welfare, pension and fringe employee benefits and payments of any kind paid or given pursuant to such agreement.

Labor Rates means a sum equal to the regular hourly wage rate required to be paid to Others (hereinafter defined) employed in Class A Office Buildings pursuant to an agreement between R.A.B. and Local 32B-32J; provided, however, that if, as of October 1st of any Comparison Year, any such agreement shall require Others in Class A Office Buildings to be regularly employed on days or during hours when overtime or other premium pay rates are in effect pursuant to such agreement, then the term "regular hourly wage rate", as used in this subsection A(ix) shall mean the average hourly wage rate for the hours in a calendar week during which Others are required to be regularly employed; and provided, further, that if no such agreement is in effect as of October 1st of any Comparison Year with respect to Others, then the term "regular hourly wage rate", as used in this subsection A(ix) shall mean the regular hourly wage rate actually paid to Others employed in the Building by Landlord or by an independent contractor engaged by Landlord; and provided, further, the term "regular hourly wage rate" in all events shall include all payments and benefits of any kind, including, but not limited to, those payable directly to taxing authorities or others on account of the employment and all welfare, pension benefits and payments of any kind paid or given pursuant to such agreement, but shall specifically exclude any fringe employee benefits.

Labor Rates means a sum equal to the regular hourly wage rate required to be paid to Others (hereinafter defined) employed in Class A Office Buildings pursuant to an agreement between R.A.B. and Local 32B-32J (exclusive of fringe benefits); provided, however, that if, as of January 1st of any Operation Year, any such agreement shall require Others in Class A Office Buildings to be regularly employed on days or during hours when overtime or other premium pay rates are in effect pursuant to such agreement, then the term "regular hourly wage rate", as used in this subsection shall mean the average hourly wage rate for the hours in a calendar week during which Others are required to be regularly employed; and provided, further, that if no such agreement is in effect as of January 1st of any Operation Year with respect to Others, then the term "regular hourly wage rate", as used in this subsection shall mean the regular hourly wage rate actually paid to Others employed in the Building by owner or by an independent contractor engaged by Owner.

Labor Rates. Labor rates will be set at the start of the retrofit process. These rates will remain in effect for the duration of the retrofit agreement.

Labor Rates means the proposed rates that must include travel, per diem, fringe benefits, and any overhead costs for contractor personnel as well as subcontractor personnel, if appropriate. If the Offeror proposes for construction services, the labor rates must also include mobilization and demobilization.

Labor Rates means, for Contractor and Contractor ‘s staff, the fully burdened, all-inclusive rates for services set forth in Exhibit C1 (Rate Schedule Pricing) and Exhibit C2 (Preventative Maintenance Equipment Pricing) of this Agreement, which rates include an allocated average of direct and indirect costs, overhead, travel expenses, and administrative expenses.

Labor Rates with respect to any Escalation year shall mean the regular average hourly wage rate required to be paid to Porters in Class A Office Buildings pursuant to any agreement between R.A.B. and Local 32B in effect during such Escalation Year, provided that if any such agreement shall require Porters to be regularly employed on days or during hours when overtime or other premium pay rates are in effect, then the term "regular average hourly wage rate" shall mean the regular average hourly wage rate for the hours in a calendar week which Porters are required to be regularly employed (whether or not actually at work in the Building), e.g., if as of November 1, 1983, an agreement between R.A.B. and Local 32B would require the regular employment of Porters for 40 hours during a calendar week at a regular hourly wage of $4.00 for the first 30 hours and at an overtime hourly average wage of $5.00 for the remaining 10 hours, then the regular average hourly wage rate under this Subsection, as of November 1, 1983, would be the sum arrived at by dividing the total weekly average wages of $170.00 by the total number of required hours of employment which is 40 and resulting in a regular average hourly wage rate of $4.25. The computation of the regular average hourly rate shall be on the same basis whether based on an hourly or other pay scale but predicated on the number of hours in such respective work weeks, whether paid by Landlord or any independent contractor. Such regular average hourly wage rate shall also be inclusive of the monetary value or cost of all payments or benefits of every nature and kind (including those required to be paid by the employer directly to taxing authorities or others because of the employment) including social security, unemployment and other similar taxes, and vacation pay, absent fund, birthdays. jury duty, medical checkup, relief time and other paid time-off, incentive pay, sick pay, accident, health and welfare insurance programs, pension plans, public liability insurance, guaranteed payment plans, and supplemental unemployment benefit programs of a similar or dissimilar nature, irrespective of whether they may be required by any Legal Requirement or otherwise. Labor Rates for Services charged on a time and materials basis will be charged on a Billable Hour basis at the hourly rates set forth in Attachment 4-A. [ * * *]

Labor Rates means IPC’s then-current time and materials rates applicable to Professional Services and certain other services as specified in the Agreement. Such rates may include standard rates applicable during the Business Day, overtime rates outside the Business Day, minimum charges, and IPC suppliers’ and subcontractors’ costs on labor and materials relating to the performance of such services.

As used herein the term "fringe benefits" shall mean all fringe benefits, including, but not limited to, amounts for, allocable to or attributable to, pensions, welfare funds, dental and training fund contributions, holidays, absent fund, social security, unemployment, disability benefits, health, life, accident, workmen's compensation and other types of insurance. If length of service shall be a factor in determining any element of fringe benefits such as vacation pay, it shall be conclusively presumed that all employees have two years of service. The hourly cost of fringe benefits shall be computed by dividing the annual total amount so payable by Owner to or for the benefit of Others for fringe benefits by the number of hours (including any mandatory overtime) that Others are actually required to work in that Escalation Year, after first subtracting all the paid time off, including, but not limited to, vacations, sick days, birthdays, jury duty, lunch hours, medical check up, relief time and absentee hours and other paid time off, to which Others may be entitled pursuant to an agreement between R.A.B. and Local 32B-32J or if there is no such agreement in effect as of January 1st of any Escalation Year with respect to Others, pursuant to any agreement with Others by Owner or by an independent contractor en...
