Survival of Terms and Conditions. The Parties understand and agree that all terms and conditions of the Agreement that require continued performance, compliance, or effect beyond the termination date of the Agreement shall survive such termination date and shall be enforceable in the event of a failure to perform or comply.

Threats to oystercatchers include over wash, predation, and human disturbance. Pairs nesting on small islands without large Laughing Gull colonies fare better than those associated with Laughing Gull colonies on large islands. However, smaller islands are typically lower in elevation and have a higher risk of over wash. Xxxx Xxx’x Reef is a reef complex in eastern Xxxxxxxx Xxxxx Bay that has eroded over the past several years. An American Oystercatcher (AMOY) pair has successfully reproduced on a larger island at the eastern end of the reef; however, nests by other pairs at this site have been washed over by spring tides. San Antonio Bay Partnership (SABP) will use CMP Cycle 26 funds to restore a small island within the Xxxx Xxx’x Reef complex to a viable nesting site for American Oystercatchers. Approximately 600 sq ft of the 1850 sq ft island will be elevated by up to 2 ft with bagged oyster shell, then covered with shell hash to provide suitable nesting habitat. The higher elevation will lessen wash over events during spring high tides. Volunteers will bag, transport, and place the shell at the site.
